Bombay HC Upholds Naresh Goyal and Wife quashes ED’s ECIR
On Thursday, the Bombay High Court quashed the Enforcement Case Information Report (ECIR) registered by the Enforcement Directorate against Jet Airways founder Naresh Goyal and his wife Anita Goyal. The ECIR was based on a First Information Report (FIR) filed by police, alleging cheating and forgery on the part of Goyals, in response to a complaint from Akbar Travels.
A division bench of Justices Revati Mohite Dere and Prithviraj Chavan, after hearing both sides, declared the ECIR registered on February 20, 2020, and all proceedings against Goyals to be illegal and contrary to law and quashed them accordingly. Generally, the Police or the Central Bureau of Investigation, or any other agencies register ECIRs, similar to FIRs, are cases of criminal activity.
In March 2020, the Mumbai Police filed a closure report on a complaint that was the basis for the registration of the ECIR in 2018. The report stated they found no substance in the complaint and the dispute seemed to be civil in nature.
Consequently, Goyals’ lawyers Ravi Kadam and Aabad Ponda submitted the report.
A magistrate’s court accepted the report that the police had filed against the Goyals, based on a complaint from Akbar Travels. According to the travel agency, they had suffered a financial loss of over Rs 46 crore following the termination of a particular airline’s operations in October 2018.
