NCLT Sets Date of June 16 to Review Wilmington’s Insolvency Plea Against SpiceJet

The National Company Law Tribunal (NCLT) has scheduled the next hearing for aircraft lessor Wilmington’s insolvency plea against SpiceJet on June 16, 2023, according to news agency ANI. Wilmington had previously approached the NCLT to initiate insolvency proceedings against the airline.

In May, Wilmington Trust SP Services, along with two other lessors, Sabarmati Aviation Leasing and Falgu Aviation Leasing, approached the Directorate General of Civil Aviation (DGCA), the aviation regulator in India, requesting the deregistration of three planes belonging to SpiceJet. Observers interpreted this move by the lessors as an attempt to exert pressure on the airline amidst their ongoing dispute.

The NCLT had earlier issued a notice to SpiceJet in response to a petition filed by an aircraft lessor, seeking the initiation of insolvency resolution proceedings against the airline. The Ajay Singh-promoted private carrier was required to respond to the petition and present its case in the upcoming hearing.

SpiceJet currently operates a fleet of 67 aircraft, consisting of Boeing 737, B737 Max, and Bombardier-Q400 regional jets. As of early May, 37 of these aircraft were in active service, while the remaining 30 were not operational, as reported by ANI, citing data from an aircraft tracking website.

The ongoing legal battle between Wilmington and SpiceJet has raised concerns about the financial stability of the airline. The insolvency plea could potentially have significant implications for the company’s operations and its ability to service its debt and obligations.
