Wilmington, Aircraft Lessor, Initiates Insolvency Proceedings against SpiceJet
In a significant development, Wilmington Trust SP Services, an aircraft lessor, has taken legal action by moving the National Company Law Tribunal (NCLT) to initiate insolvency proceedings against SpiceJet, one of India’s leading budget carriers. News agency ANI reported on June 11 that aircraft lessor Wilmington Trust SP Services has moved the National Company Law Tribunal (NCLT) to initiate insolvency proceedings against SpiceJet.
The Delhi National Company Law Tribunal (NCLT) has scheduled a hearing on June 12 to decide the fate of SpiceJet, as Wilmington Trust SP Services, an aircraft lessor, has initiated insolvency proceedings against the airline. This move comes after Wilmington Trust SP Services, along with two other lessors, Sabarmati Aviation Leasing and Falgu Aviation Leasing, approached the Directorate General of Civil Aviation (DGCA) in May to seek the deregistration of three aircraft leased to SpiceJet.
It is important to note that SpiceJet has been facing operational challenges, leading to a significant number of its aircraft remaining grounded for various reasons. This has undoubtedly affected the airline’s financial stability and lease agreements with lessors.
The NCLT had previously issued a notice to SpiceJet in May, in response to a petition filed by an aircraft lessor seeking the initiation of insolvency resolution proceedings. This recent action by Wilmington Trust SP Services further compounds the airline’s troubles and adds to the uncertainty surrounding its future.
SpiceJet Operators
SpiceJet currently operates a fleet of 67 aircraft, including Boeing 737, B737 Max, and Bombardier-Q400 regional jets. As of early May, according to ANI, 37 of these aircraft were in service, while the remaining 30 were grounded or not in operation.
The initiation of insolvency proceedings by Wilmington Trust SP Services reflects the gravity of the situation and the growing concerns of lessors regarding the airline’s ability to meet its financial obligations. Insolvency proceedings against SpiceJet could potentially lead to a restructuring of the airline’s debt, changes in management, or even the acquisition of the airline by another entity.
The aviation industry will closely watch the outcome of the hearing at the NCLT, as it will have significant implications for SpiceJet and its stakeholders. The airline has been a prominent player in India’s aviation sector, providing affordable air travel to millions of passengers. However, the recent challenges faced by the company have raised questions about its long-term viability and ability to sustain operations.
The insolvency proceedings against SpiceJet highlight the broader issues faced by the aviation industry, including the impact of the COVID-19 pandemic, volatile fuel prices, intense competition, and regulatory hurdles. As the industry continues to grapple with these challenges, it is crucial for airlines and stakeholders to find sustainable solutions to ensure the stability and growth of the sector.
The hearing at the NCLT will provide further clarity on the path ahead for SpiceJet. The airline’s management, along with its creditors and lessors, collaboratively address the financial and operational challenges, with the aim of safeguarding the interests of all stakeholders and securing a sustainable future for the airline.
